Nu Metro Secret Garden Promotion and Competition Terms and Conditions

1. By participating in this promotion and competition, you agree to the following terms and conditions, which are relevant to the promotion and competition.
2. The Nu Metro “Secret Garden” Promotion entails:
   • The issue of one Livingseeds Pollinator Blend seed pack with every movie ticket purchased for The Secret Garden at Nu Metro between 2nd October 2020 and 25 October 2020, while stocks last.
   • The issue of one Livingseeds discount voucher redeemable for online orders from www.livingseeds.co.za between 9 October 2020 and 30 January 2021.
3. The Nu Metro “Secret Garden” Competition entails:
   • The issue of one voucher containing a UNIQUE CODE, with every movie ticket purchased for The Secret Garden at Nu Metro between 2nd October 2020 and 25 October 2020.
   • Entering by SMS using the competition keyword GARDEN, and the UNIQUE CODE on the voucher issued, and your NAME to 40675.
   • One prize consisting of one Livinseeds voucher to the value of R5000 (five thousand rand) to be redeemed against online orders from www.livingseeds.co.za
4. Competition entries must be received by no later than 23:59 on the 25th October 2020. Entries received after this time will not be accepted
5. The Competition is open to anyone in South Africa, who purchases at least 1 (one) movie ticket for The Secret Garden movie at Nu Metro Ballito Junction, or Nu Metro Canal Walk, or Nu Metro Hyde Park, or Nu Metro Menlyn Park, or Nu Metro Pavilion cinemas during the competition period.
6. You must purchase a movie ticket for The Secret Garden movie to receive a UNIQUE CODE to be eligible for entry.
7. To enter, you must do the following:
   • Purchase a movie ticket for The Secret Garden movie at Nu Metro Ballito Junction, or Nu Metro Canal Walk, or Nu Metro Hyde Park, or Nu Metro Menlyn Park, or Nu Metro Pavilion cinemas during the competition period;
   • Receive a voucher with a UNIQUE CODE for eligible purchases;
   • SMS the word GARDEN and the UNIQUE CODE found on the voucher received and YOUR NAME to 40675;
   • You must be a natural person and 18 (eighteen) years of age or older to be eligible to win.
8. SMSes are charged at R1,00 (one rand) per SMS. The costs are for the customer’s account. No free SMS bundles apply.
9. Each UNIQUE CODE may be used once only.
10. Entry is open to individual entrants only – group and company entries are not permitted.
11. Each person is allowed unlimited entries into the competition, provided all the entry criteria as set out in the terms and conditions have been met.
12. Nu Metro and Livingseeds accepts no responsibility for lost tickets or incorrect entries.
13. One potential Winner will be chosen by means of a random draw, which will take place on Wednesday 28th October 2020, or as soon as possible thereafter, should additional potential winners need to be drawn.
14. The potential winner will be contacted telephonically by a senior representative of Nu Metro Cinemas by no later than Friday 30th October 2020, or as soon as possible thereafter where additional potential winners had to be drawn. Potential Winners will be contacted by email or phone. 3 (three) attempts will be made to contact the winner over a 48-hour period. If a selected potential winner is not contactable, a runner-up potential winner will be selected until five potential winners are contacted.
15. Nu Metro shall review the selected potential winners to confirm that all agreed Terms and Conditions of the Competition are satisfied to verify that the selected winner is eligible to win.
16. Nu Metro’s decision is final and no correspondence will be entered into.
17. Nu Metro cinemas will use any means available to contact winners by the stipulated dates. Should Nu Metro Cinemas be unable to contact winners and verify the winners within 1 (one) week of the prize draw, Nu Metro reserves the right to hold another random draw and allocate the prize to another entrant (the “Redraw”). This will apply to all subsequent winners of any Redraws.
18. Once the Winner has been notified and accepted the Prize, a handover of the prize will be arranged.
19. One winner will receive one prize valued at R5 000,00 (five thousand rand).
20. The prize consists of one online Livingseeds voucher redeemable from www.livingseeds.co.za
21. Please note the following terms and conditions for use of the prize:
    • Livingseeds voucher is only valid for purchases made on the Livingseeds website;
    • The Livingseeds voucher cannot be exchanged for cash;
    • The Livingseeds voucher is valid for redemption between 25 October 2020 and 25 October 2023.
22. The prize must be taken as-is. The prize is not transferable and cannot be exchanged for cash
23. By participating in this competition and accepting the prize, the winner agrees to the publication of their name and/or photographs on any platforms that Nu Metro Cinemas and Livingseeds sees fit.
24. This includes (but is not limited to) print advertising, digital advertising, social media posts, and websites.
25. The Competition and the awarding of prizes are held in accordance with the Consumer Protection Act, 2008, of South Africa and specifically the regulations governing promotional competitions. Any changes required to these terms and conditions in order to comply therewith will be effected without notice.
26. Nu Metro Cinemas’ and Livingseeds’ directors, members, shareholders, partners, employees, agents, or consultants and their spouses, life partners, parents, children, siblings, business partners or associates, subsidiaries and/or holding companies are not eligible to participate in or enter this competition.
27. All information relating to this competition and published on any promotional or advertising material forms part of these terms and conditions of entry.
28. Nu Metro reserves the right to reject any entrant/winner from the competition at its sole discretion.
29. In the event of a dispute, the decision of Nu Metro Cinemas will be final and binding on all aspects of this competition and no correspondence will be entered into.
30. Nu Metro Cinemas, its directors, members, partners, employees, agents, consultants, suppliers, contractors, subsidiaries and/or holding companies are indemnified against and assume no liability whatsoever for any direct or indirect loss, harm or damage to person or property arising from an entrants’ participation in this competition or for any loss or damage, howsoever arising.
31. If required by law or for whatever other reason at the discretion of Nu Metro, Nu Metro Cinemas shall have the right to terminate this competition with immediate effect, or vary the Terms and Conditions thereof, and without notice of such termination or variation to any entrants or winners. In such event, all entrants hereby waive any rights that they may have against Nu Metro Cinemas for any direct or indirect damages and hereby acknowledge that they will have no recourse or claim of any nature whatsoever against either company, subsidiary, or holding company, their directors, members, partners, employees, agents or consultants.
32. If Nu Metro Cinemas suspects foul play by any entrant/participant/winner, Nu Metro is entitled to disqualify the participant/entrant/winner with immediate effect. Nu Metro Cinemas’ decision regarding this is final and no correspondence will be entered into.
33. Entrants to the competition are responsible for entering their correct personal details and should they win, Nu Metro Cinemas will not be held liable should the details submitted be incorrect.
34. Should any of the Winners, for any reason whatsoever, including any failure/negligence on the part of Nu Metro Cinemas or Livingseeds, its directors, members, partners, employees, sponsors, agents or consultants, be unable or unwilling to take up the prize before the expiry of the prize then no liability shall attach to Nu Metro Cinemas, their directors, members, partners, employees, agents or consultants.
35. By participation in this promotion all entrants/winners participating in this promotion and the Winners’ guests agree that they do so strictly and entirely at their own risk and that Nu Metro Cinemas and Livingseeds, its respective shareholders, directors, officers, employees, subcontractors, agents and/or affiliates, in whole or in part, shall not be liable for any loss, injury, death, and/or damage (including but not limited to general, consequential or special damages or loss of profits) of whatsoever nature and howsoever arising (including but not limited to whether directly or indirectly or whether or not by way of negligence) to any person and/or other person (third party), dependents, assignees, executors, trustees or legal representatives.
36. Nu Metro Cinemas reserves the right to amend these terms and conditions at any time without further notice.
37. By participating in the competition, you agree to receive marketing communication from Nu Metro Cinemas and Livingseeds.
